Ordinance Restricting The Operation Of Snowmobiles Or Off-Road Vehicles Upon A Highway, Street, Alley Within The Town Of Redkey
Be It Ordained By The Town Board of The Town Of Redkey, Jay County, Indiana As Follows:
Definitions. For the purpose of this ordinance, the following definitions shall apply unless the context clearly indicates that requires a different meaning.
Highway, Street or right-of-way: the entire width between the boundary lines of every publicly maintained area of travel when any part thereof is open to use of public for purposes of vehicular travel.
Off-road vehicles: (1) a motorized vehicle capable of cross-country travel, without benefit of road or trail, on or immediately over land, water, snow, ice, marsh, swampland or other natural terrain. It includes, but is not limited to, a multi-wheel drive for low-pressure tire vehicle, amphibious machine, ground effect air-conditioned vehicle or other means of transportation riding motor power from a source other than muscle or wind. (2) It does not include a farm vehicle being used for fanning, the vehicle used for military or law enforcement purposes, construction, mining or other industrial related vehicles used in performance common function, golf carts and does not include any other vehicle properly registered by the Bureau of Motor
vehicles or any watercraft which is registered pursuant to state law.
Operate: To ride in or on and to be in the actual physical control the operation of an off-road vehicle.
Operator: Any person who operates or is in actual physical control of an off-road vehicle.
(A) a person shall not operate an off-road vehicle upon a Highway, Street, Alley or right-of-way within the Town of Redkey or upon any public or private parking lot except under the following conditions and circumstances:
(1) when authorized by the Town Marshal during snow emergencies when conventional motor vehicles cannot be used for transportation or other extreme conditions.
Any operator of an off-road vehicle bound to the violation of this ordinance and convicted thereof shall be punished by a fine of not more than $50.00. A separate offense shall be deemed committed on each day that a violation occurs or continues.
This Ordinance was duly passed in regular session of the Town Board of the Town of Redkey, Jay County, Indiana, on this 24th day of July, 2014.
